| چکیده | ||
| امروزه سفرههای آب زیرزمینی مهمترین منبع تأمین آب شیرین برای انسانها هستند. به همین دلیل قسمت اعظم استخراج منابع زیرزمینی توسط دولتها بر این حوزه متمرکز است. مهمترین چالشهای پیش روی دولتها در خصوص سفرههای آب زیرزمینی فرامرزی مربوط به رژیم حقوقی حاکم و نحوه بهرهبرداری، استخراج و مدیریت این ذخائز میگردد. برای پاسخگویی به این مسائل کمیسیون حقوق بینالملل طرح پیشنویس حقوق سفرههای آب زیرزمینی فرامرزی را در دستور کار خود قرار داد. این پیشنویس در سال 2008 به نتیجه رسید و به مجمع عمومی ملل متحد ارائه گردید. پیشنویس کمیسیون حقوق بینالملل راجع به سفرههای آب زیرزمینی فرامرزی علیرغم نواقصی که در آن وجود دارد حرکت تحسینبرانگیزی از سوی کمیسیون حقوق بینالملل در جهت توسعه تدریجی و تدوین حوزههای نوین حقوق آبهای زیرزمینی است. این پژوهش ضمن بررسی پیشنویس کمیسیون حقوق بینالملل راجع به حقوق سفرههای آب زیرزمینی فرامرزی به تحلیل نقاط ضعف و قوت این پیشنویس میپردازد. | ||
