دکترین حاشیه مجاز تفسیر در رویه دادگاه اروپایی حقوق بشر | ||

| چکیده | ||
| در خصوص ماهیت دکترین حاشیه مجاز تفسیر، دیدگاههای متفاوتی وجود دارد. برخی بر این باورند که اگرچه دکترین مزبور امکان اجرای حقوق بشر بر اساس ویژگیهای محلی را امکانپذیر ساخته، اما نحوه استفاده آن توسط دادگاه اروپایی حقوق بشر به نسبیگرایی منتهی نشده است. ولی این نوشتار بر این باور است که دکترین مزبور ریشه در نسبیگرایی ضعیف (جهانشمولی قوی) دارد. بررسی دلایل منطقی و مبانی اعمال دکترین حاشیه مجاز تفسیر در رویه دادگاه اروپایی حقوق بشر، تأملی بر آرای دادگاه در این زمینه و همچنین بررسی مباحث پیرامون ماهیت نسبیگرایی این دکترین در ادبیات، شواهدی دالّ بر تأیید این مدعا است که حاشیه مجاز تفسیر، ریشه در نسبیگرایی فرهنگی دارد. از طرفی دیگر، با مطالعه کمّی و کیفی تنوعات پذیرفته شده از طرف این دکترین، از مجرای بررسی: حوزه، گستره و استانداردهای کاربست حاشیه مجاز تفسیر در رویه دادگاه اروپایی حقوق بشر، این نتیجه حاصل میشود که نسبیگرایی مذکور را میتوان نسبیگرایی ضعیف نامید. | ||
