| چکیده | ||
| چکیده: محل سکونت عادی در مقررات اتحادیهی اروپا یک عامل ارتباط مهم در تعارض دادگاهها و تعارض قوانین بهویژه در مسائل احوال شخصیه است. آییننامههای اتحادیه اروپا که بهطور مستقیم و بدون نیاز به تصویب مراجع داخلی کشورها لازمالاجرا است، بهطور مکرر از این عامل ارتباط بهره برده و آن را جایگزین عوامل ارتباط سنتی ازجمله اقامتگاه در کشورهای کامنلا و تابعیت در کشورهای رومی ژرمنی قرار داده است. پذیرش عامل عینی سکونت بهجای اقامتگاه، قابلیت پیشبینی در روابط بینالمللی را افزایش میدهد. درعینحال با تمرکز بر رابطه نزدیک میان اشخاص و قانون قابل اعمال موجب ایجاد انعطاف در قواعد حل تعارض میشود و برخلاف تابعیت از اعمال مطلق قانون یک کشور معین جلوگیری مینماید. بهعلاوه دادگاه با اعمال ضابطه محل سکونت عادی غالباً به اعمال قواعد مادی قانون مقر دادگاه هدایت میشود و از مشکلات استناد و اثبات قانون خارجی رهایی مییابد. | ||
