| چکیده | ||
| امروزه قانون نمونه داوری آنسیترال بهعنوان قانونی مدرن برای وضع قوانین به کار میرود. گرایش غالب در بسیاری از کشورهای دنیا به ایجاد سیستم داوری واحد بر مبنای قانون نمونه است. در ایران پس از تصویب قانون داوری تجاری بینالمللی، داوری داخلی و داوری بینالمللی از یکدیگر تفکیک شد. با توجه به عدم وجود مقررات مدرن داوری در آیین دادرسی مدنی و تغییرات نامناسبی که قانون داوری تجاری بینالمللی نسبت به قانون نمونه آنسیترال اعمال نمود، ساختار حقوقی داوری ایران ساختار مناسبی بهنظر نمیرسد. هدف این مقاله این است که با بررسی گرایش ساختار داوری کشورهای توسعهیافته و نقش موثر قانون نمونه، پیشنهاد کند که مبنای حقوق داوری ایران باید سیستم واحد باشد که نهتنها باید با قانون نمونه سازگار باشد بلکه باید پا را فراتر نهاده و قانون جامع داوری مدرن تدوین کند. | ||
