| چکیده | ||
| دادهها اصولاً موضوع حمایتهای انحصاری نیستند و از اصل تشریک دادهها تبعیت میکنند. باوجوداین، برخی دادهها، بنا به دلایل و توجیهات خاص، بهطور استثنایی موضوع حمایتهای قانونی قرارگرفتهاند. حمایت از دادههای آزمایشی یکی از این موارد استثنایی است. حمایت از این دادهها در سطح ملی، بر مبنای سیاستهای کلان کشورها و سطح توسعهیافتگی آنها انجام میشود و این امر خود باعث تنوع شیوههای حمایت دراینباره شده است. در سطح بینالمللی نیز حمایت از این دادهها موردتوجه قرارگرفته است. موافقتنامۀ جنبههای مربوط به تجارت حقوق مالکیت فکری (تریپس) مهمترین سند بینالمللی در این زمینه است که در بند 3 مادة 39 رژیم حمایتی خاصی برای این دادهها پیشبینی کرده است. در این مقاله، ضمن تبیین مفهوم دادههای آزمایشی، ضرورت و شیوة حمایت از آنها بر مبنای بند 3 مادة 39 تریپس را مطالعه و درنهایت قالب حمایتی مناسب با کشور ایران، بهعنوان کشوری درحالتوسعه، ارائه میشود. واژگان کلیدی: دادههای آزمایشی، موافقتنامه تریپس، مالکیتهای فکری، اسرار تجاری، اطلاعات افشا نشده | ||
